Appeal Filed Against You?
We have observed a dramatic increase in the number of appeals that are being filed by the various taxing authorities (School Districts, Municipalities, and Allegheny County). This is not really surprising considering the fact that county-wide the Property Assessments lack uniformity and continue to be a complete mess. We are aware of the fact that the taxing bodies are filing appeals against property owners based solely on the fact that the sale price exceeds the previous assessed value. It is our belief that the taxing bodies are appealing all new sales if the sale price exceeds the previous assessment.
Sale price IS NOT the same as Fair Market Value. This is a common misconception among property owners. Just because you were willing to pay a particular price for your property does not mean that the Fair Market Value of that property is now the price paid. Property owners pay premium prices for properties for a variety of reasons that are not appealing to other potential buyers. While Sale Price is a factor to be considered when determining Fair Market Value there are many other factors that also need to be considered in determining FMV. Those factors can be used to dispute the taxing authorities’ contention that that Sale Price is the Fair Market Value. That is where our expertise and experience becomes extremely important.
